There is hereby adopted and incorporated by reference, for the purpose of establishing rules and regulations for the construction, alteration, addition, demotion, equipment, use and occupancy, location and maintenance of buildings and structures within the corporate city limits of the City of Beloit, Kansas, the International Residential Code for One-and Two-Family Dwellings, 2003 Edition, including only Appendices E and G, as recommended by the International Code Council, such code being made as a part of the ordinances and code of the City as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012 including any amendments thereto subject to certain omissions, changes and additions, if any, as set forth in this article. No fewer than three copies of the International Residential Code for One-and Two-Family Dwellings, 2003 Edition, shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Beloit” and shall be filed with the city clerk to be open to inspection and available to the public at all reasonable hours of business.

(a)   Chapter 1, Section R101.1 Title of said International Residential Code for One- and Two-Family Dwellings is hereby changed to read as follows:

(1)   Chapter 1, Section R101.1 Title. These provisions shall be known as the “Residential Code for One- and Two-Family Dwellings of the City of Beloit, Kansas”, hereinafter referred to as “this code”.

(b)   Chapter 1, Section R105.2 Work exempt from permit of said International Residential Code for One-and Two-Family Dwellings is hereby changed to read as follows:

(1)   Chapter 1, Section R105.2 Work exempt from permit. Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall be exempt for all work except the following list of projects:

(A)  Buildings.

(i)    All new construction of One- and Two-Family Dwellings and Townhouses.

(ii)   Any addition that changes the outside footprint of a building, vertical or horizontal.

(iii)  Any new motor vehicle garage, attached or detached.

(iv)  Decks and patios over 30” above grade.

(v)   Structural changes in existing buildings or roofs, walls or floors.

(vi)  Patio roofs or porch roof construction.

(B)  Mechanical. (heating, air-conditioning, and ventilation)

(i)    All new construction.

(ii)   Fireplaces and free-standing stoves.

(C)  Plumbing (including gas, water, sewer, and other piping systems)

(i)    All new construction.

(ii)   New service from main to structure.

(iii)  Replacement of existing service between main and structure.

(iv)  Gas piping installed by KGS recommendations.

(D)  Electrical.

(i)    All new construction.

(ii)   New additions to existing dwelling units, vertical or horizontal.

(iii)  Replacement of service entrance equipment.

(iv)  Wiring to pools or spas except a whirlpool type tub.

(E)   Pools and Spas. (temporary or permanent)

(i)    Above ground, on ground or below grade over 24” deep

(F)   Water Features. (zoning)

(i)    Permit required for electrical safety inspection.

(c)   Chapter 1, Section R113.4 Violation penalties of said International Residential Code is hereby changed to read as follows:

(1)   Chapter 1, Section R113.4 Violation penalties. Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as set forth in Section 15 herein.

(d)   Chapter 3, Table R301.2(1). Climatic and geographic design criteria of said International Residential Code for One- and Two-Family Dwellings is hereby changed to read as follows:

(e)   Chapter 26, Section P2603.6.1 Sewer depth of the International Residential Code for One-and Two-Family Dwellings is hereby changed to read as follows:

(1)   Chapter 26, Section P2603.6.1 Sewer Depth. Whenever possible, building sewers that connect to private sewage disposal systems shall be a minimum of 36 inches below finished grade at the point of septic tank connection. Whenever possible, building sewers shall be a minimum of 36 inches below grade unless insulated.

(f)    Chapter 31, Section P3103.1 Roof extension of the International Residential Code for One- and Two-Family Dwellings is hereby changed to read as follows:

(1)   Chapter 31, Section P3103.1 Roof extension. All open vent pipes which extend through a roof shall be terminated at least six (6) inches above the roof or six (6) inches above the anticipated snow accumulation, except that where a roof is to be used for any purpose other than weather protection, the vent extensions shall be run at least seven (7) feel (2145 mm) above the roof.
