There is hereby adopted and incorporated by reference, for the purpose of establishing rules and regulations for the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of electrical systems performed within the corporate city limits of the City of Beloit, Kansas, the NFPA 70 National Electrical Code, 2002 Edition, as approved by the American National Standards Institute on August 2, 2001, such code being made as a part of the ordinances and code of the City as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012 including any amendments thereto subject to certain omissions, changes and additions, if any, as set forth in this article. No fewer than three copies of the NFPA 70 National Electrical Code, 2002 Edition, shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Beloit” and shall be filed with the city clerk to be open to inspection and available to the public al all reasonable hours of business.

(a)   Article 80 Administration and Enforcement of said NFPA 70 National Electrical Code is hereby declared to be and is omitted and deleted and the International Code Council Electrical Code - Administrative Provisions, Edition 2003 is hereby adopted and incorporated by reference in its place and such ICC Electrical Code - Administrative Provisions is made a part of the ordinances and code of the City as if the same had been set out in full herein except as omitted, deleted, modified or amended herein.

(b)   Article 210, Section 210.12(B) Dwelling Unit Bedrooms of said NFPA 70 National Electrical Code is hereby declared to be and is omitted and deleted.

(c)   Changing provisions of International Code Council Electrical Code - Administrative Provisions adopted and incorporated at Section 4-402(a).

(1)   Chapter 1, Section 101.1 Title of said International Code Council Electrical Code - Administrative Provisions is hereby changed to read as follows:

(A)  Chapter 1, Section 101.1 Title. These regulations shall be known as the “Electrical Code - Administrative Provisions of the City of Beloit, Kansas” and shall be cited as such and will be referred to herein as “this code”.

(2)   Chapter 3, Section 301 Department of Electrical Inspection of said International Code Council Electrical Code - Administrative Provisions is hereby declared to be and is omitted and deleted.

(3)   Chapter 4, Section 404.2 Schedule of permit fees of said International Code Council Electrical Code - Administrative Provisions is hereby changed to read as follows:

(A)  Chapter 4, Section 404.2 Schedule of permit fees. The fee for electrical work shall be established by resolution of the governing body of the city.

(4)   Chapter 10, Section 1003.1 Penalties of said International Code Council Electrical Code - Administrative Provisions is hereby changed to read as follows:

(A)  Chapter 10, Section 1003.1 Penalties. Any person who fails to comply with the provisions of this code or who fails to carry out an order made pursuant of this code or violates any condition attached to a permit, approval, or certificate shall be subject to penalties as set forth in Section 15 herein.
