There is hereby adopted and incorporated by reference, for the purpose of establishing rules and regulations for the construction, alteration, addition, demolition, equipment, use for the construction, alteration, addition, demolition, equipment, use and occupancy, location and maintenance of buildings and structures within the corporate city limits of the City of Beloit, Kansas, the International Building Code, 2003 Edition, including only Appendices B and I, as recommended by the International Code Council, such code being made as a part of the ordinances and code of the City as if the same has been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012 including any amendments thereto, subject to certain omissions, changes and additions, if any, as set forth in this article. One copy of the International Building Code, 2003 Edition, shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Beloit” and shall be filed with the City Clerk to be open to inspection and available to the public at all reasonable hours of business.

(a)   Chapter 1, Section 101.1. Title of said International Building Code is hereby changed to read as follows:

(1)   Chapter 1, Section 101.1 Title. These regulations shall be known as the “Building Code of the City of Beloit, Kansas”, hereinafter referred to as “this code”.

(b)   The first paragraph of Chapter 1, Section 101.2. Scope. Of said International Building Code is hereby changed to read as follows:

(1)   Chapter 1, Section 101.2. Scope. The provisions of this code shall apply to the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of buildings and structures or any appurtenances connected or attached to such buildings or structures.

(c)   Chapter 1, Section 105.2 Work exempt from permit of said International Building Code is hereby changed to read as follows:

(1)   Chapter 1, Section 105.2 Work exempt from permit. Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall be exempt for all work except the following list of projects:

(A)  Buildings.

(i)    All new construction.

(ii)   Any addition that changes the outside footprint of a building, vertical or horizontal.

(iii)  Any new one-story detached accessory structure used as tool and storage sheds, playhouses and similar uses, when the floor area exceeds 200 square feet.

(iv)  Sidewalks, driveways, decks and patios over 30” above grade.

(v)   Structural changes in existing buildings of roofs, walls or floors.

(vi)  Structural roofs or lean-to-type roof construction.

(B)  Mechanical. (heating, air-conditioning, and ventilation)

(i)    All new construction.

(ii)   Fireplaces and free standing stoves.

(iii)  Replacement of furnaces, gas or electric.

(iv)  New installation or replacement of gas fired appliances.

(C)  Plumbing. (including gas, fire sprinkler systems, water, sewer and other piping systems)

(i)    All new construction.

(ii)   New services or replacement of existing services between mains and structure.

(iii)  Gas piping installed by KGS recommendations.

(D)  Electrical.

(i)    All new construction.

(ii)   New circuits to existing structures.

(E)   Pools and Spas. (temporary or permanent)

(i)    In ground, above ground or on ground over 24” deep.

(F)   Water Features. (zoning)

(i)    Permit required for electrical safety inspection.

(G)  Demolition.

(i)    Permit required for any complete demolition of commercial/industrial buildings or structures.

(d)   Chapter 1, Section 113.4 Violation penalties of aid International Building Code is hereby changed to read as follows:

(1)   Chapter 1, Section 113.4 Violation penalties. Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as set forth in Section 15 herein.

(e)   Chapter 16, Section 1612.3. Establishment of flood hazard areas of said International Building Code is hereby changed to read as follows:

(1)   Chapter 16, Section 1612.3. Establishment of flood hazard areas. To establish flood hazard areas, the governing body shall adopt a flood hazard map and supporting data. The flood hazard map shall include, at a minimum, areas of special flood hazard as identified by the Federal Emergency Management Agency in an engineering report. The flood hazard map adopted in Ordinance No. 1905 by the governing body of the City of Beloit, Kansas, is hereby adopted by reference and declared to be part of this section.

(f)    Chapter 34, Section 3410.2 Applicability of said International Building Code is hereby changed to read as follows:

(1)   Chapter 34, Section 3410.2 Applicability. Structures existing prior to November 3, 1953, in which there is work involving additions, alterations or changes or occupancy shall be made to conform to the requirements of this section or the provisions of sections 3403 through 3407. The provisions in sections 3410.2.1 through 3410.2.5 shall apply to existing occupancies that will continue to be, or are proposed to be, in Groups, A, B, E, F, M, R, S and U. These provisions shall not apply to buildings with occupancies in Group H or I.
