There is hereby adopted and incorporated by reference, for the purpose of establishing rules and regulations for the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems work done or performed with the corporate city limits of the City of Beloit, Kansas, the International Mechanical Code, 2003 Edition, including only Appendix A, as recommended by the International Code Council, such code being made as a part of the ordinances and code of the City as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012 including any amendments thereto subject to certain omissions, changes and additions, if any, as set forth in this article. No fewer than three copies of the International Mechanical Code, 2003 Edition, shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Beloit” and shall be filed with the City Clerk to be open to inspection and available to the public at all reasonable hours of business.

(a) Chapter 1, Section 101. Title of said International Mechanical Code is hereby changed to read as follows:
(1) Chapter 1, Section 101 Title. These regulations shall be known as the “Mechanical Code of the City of Beloit, Kansas”, hereinafter referred to as “this code”.
(b) Chapter 1, Section 103 Department of Mechanical Inspection of said International Mechanical Code is hereby declared to be and is omitted and deleted.
(c) Chapter 1, Section 106.5.2 Fee schedule of said International Mechanical Code is hereby changed to read as follows.
(1) Chapter 1, Section 106.5.2 Fee schedule. The fee for mechanical work shall be established by resolution of the governing body of the city.
(d) Chapter 1, Section 106.5.3 Fee refunds of said International Mechanical Code is hereby declared to be and is omitted and deleted.
(e) Chapter 1, Section 108.4 Violation penalties of said International Mechanical Code is hereby changed to read as follows:
(1) Chapter 1, Section 108.4 Violation penalties. Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair mechanical work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as set forth in Section 15 herein.
(f) Chapter 1, Section 108.5 Stop work orders of the International Mechanical Code is hereby changed to read as follows:
(1) Chapter 1, Section 108.5 Stop work orders. Upon notice from the code official that mechanical work is being done contrary to the provisions of this code or in a dangerous or unsafe manner, such work shall immediately cease. Such notice shall be in writing and shall be given to the owner of the property, or to the owner’s agent, or to the person doing the work. The notice shall state the conditions under which work is authorized to resume. Where an emergency exists, the code official shall not be required to give a written notice prior to stopping the work. Any person who shall continue any work on the system after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $100 or more than $500.
