A CHARTER ORDINANCE AMENDING CHARTER ORDINANCE 13 RELATED TO EXEMPTING THE CITY OF BELOIT, KANSAS, FROM THE PROVISIONS OF K.S.A. 14-205, PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT AND REMOVING LIMITATIONS ON RESIDENCY REQUIREMENTS FOR LAW ENFORCEMENT OFFICERS.

WHEREAS, in Charter Ordinance 13, the City of Beloit, Kansas, a city of the second class, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas did exempt itself and make inapplicable to it the provisions of K.S.A. 14-205 related to the residency requirements of the city clerk, chief of police, and law enforcement officers;

WHEREAS, Charter Ordinance 13 requires law enforcement officers to reside in Mitchell County, Kansas and within a 15-minute legal drive from the city limits of Beloit, Kansas; and

WHEREAS, the Governing Body has deemed it necessary to amend the residency requirements for law enforcement officers.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BELOIT, KANSAS:

SECTION 1: The City of Beloit, Kansas, a city of the second class, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas hereby does exempt itself and make inapplicable to it the provisions of K.S.A. 14-205 which applies to this city, but is part of an enactment which does not apply uniformly to all cities, insofar as said statute requires that law enforcement officers meet certain residency requirements.

SECTION 2: Section 5 of Charter Ordinance 13 is hereby amended and restated as follows:

       “Law enforcement officers need not be qualified electors of the city of Beloit, Kansas, but must be residents of the State of Kansas. Other residency requirements will be as stated in the city’s Personnel Policy, which may be amended from time to time.”
