For the purpose of this article, the following words shall mean:
(a) Approved. Acceptable to the authority having jurisdiction.
(b) Container. Any vessel, including cylinders, tanks, portable tanks and cargo tanks used for the transporting or storing of the liquefied petroleum gases.
(c) Dispensing Device (or Dispenser). A device used to transfer and measure liquefied petroleum gas for engine fuel into a fuel container, serving the same purpose for a liquefied petroleum gas service station as that served by a gasoline service station.
(d) Distributing Plant. A facility, the primary purpose of which is the distributing of gas, and which receives liquefied petroleum gas in tank car, truck transport or truck lots, distributing this gas to the end user by portable container (package) delivery, by tank truck or through gas piping.
(e) Distributing Point. A facility, other than a distributing plant or industrial plant, which normally receives gas by tank truck, and which fills small containers or engine fuel tanks of motor vehicles on the premise. Any such facility having liquefied petroleum gas storage of 100 gallons or more water capacity, and to which persons other than the owner of the facility or his employee have access, is considered to be a distributing point. A liquefied petroleum gas service is one type of distributing point.
(f) Liquefied Petroleum Gas. All devices, piping and equipment pertinent to the use of liquefied petroleum gas, except gas burning appliances.
(g) LP-Gas Service Station. See Distributing Point. A facility which consists of liquefied petroleum gas storage containers, piping and pertinent equipment, including pumps and dispensing devices, and any building in which liquefied petroleum gas is stored and dispensed into engine fuel containers of highway vehicles.
(i) Point of Transfer. The location where connections and disconnections are made or where liquefied petroleum gas is vented to the atmosphere in the course of transfer operations.
(j) PSI. PSIG, and PSIA. Pounds per square inch, pounds per square inch gauge, and pounds per square inch absolute, respectively.
(k) Sources of Ignition. Devices or equipment which, because of their modes of use or operation, are capable of providing sufficient thermal energy to ignite flammable liquified petroleum gas vapor-air mixture when introduced into such a mixture or when such a mixture comes into contact with them, and which will permit propagation of flame away from them.
(l) Water Capacity. The amount of water, in either pounds or gallons, at 60F (15.6C) required to fill a container liquid full of water.

All installations of liquefied petroleum gas equipment shall be in conformity with the provisions of this article, with the statutes of the State of Kansas and with any orders, rules or regulations issued by authority thereof and with generally recognized standards for safety to persons and property.

A permit shall be obtained from the city for each installation of liquefied petroleum gas storage containers of 2,500 gallons water capacity, individual, or with aggregate water capacity of 2,500 gallon water capacity. Prior to making such installation, an installer shall submit plans to the city.

(a) Containers, fixed or portable, are limited to a maximum size of 2,500 gallons water capacity in commercial and light industrial zones where automobile service stations are allowed by zoning regulations of the city. Residential zones are limited to a maximum storage of 1,000 gallons water capacity. Only aboveground storage will be installed.
(b) All containers shall be construed in accordance with existing regulations and codes.
(c) Container markings shall be on a metal plate attached to the container, so located as to remain visible after the container is installed:
(1) Service for which the container is designed; i.e. underground, above ground or both.
(2) Name and address of the container supplier or trade name of the container.
(3) Water capacity in pounds of U.S. gallons.
(4) Design pressure in psig.
(5) Outside surface area in square feet.
(6) The wording “This container shall not contain a product having a vapor pressure in excess of psig @ 100 deg.F.
(d) When liquefied petroleum gas and one or more compressed gases are to be stored or used in the same area, the containers shall be marked “Flammable” and either “LP-Gas,” “Propane” or “Butane.” Compliance with marking requirements of Title 48 of the “Code of Federal Regulations” shall meet this provision.

Liquefied petroleum gas and liquefied petroleum gas dispensing devices shall not be within a building but may be located under a weather shelter or canopy provided the area is adequately ventilated and not enclosed for more than 50 percent of its perimeter.

Container inlet and outlet connections, except safety relief valves, liquid gauging devices and pressure gauges, on containers of 2,000 gallons water capacity or more or on containers of any capacity used in liquefied petroleum gas service stations, shall be labeled to designate whether they communicate with the vapor or liquid space. Labels may be on valves.

To minimize the possibilities for trespassing and tampering, the area which includes container appurtenances, pumping equipment, loading and unloading facilities shall be protected by the following method:
(a) Enclosure with at least a 6 foot high industrial type fence unless otherwise adequately protected. There shall be at least two means of emergency access from the fence or other enclosure. Vehicles with permanently mounted containers shall be serviced outside the fence.

Artificial lighting shall be restricted to electricity. All electrical equipment for light and power shall be in compliance with the requirements of the National Electrical Code for Class I, Group D, Hazardous locations.

(a) Each industrial plant, distributing plant and distributing point shall be provided with at least one listed portable extinguisher having a minimum rating of 10BC.
(b) The planning for effective measures for control of inadvertent liquefied petroleum gas release or fire shall be coordinated with local emergency handling agencies such as fire and police departments.

*Sources of ignition include vehicles with engines running, smoking by personnel, fires, lighted matches, hot water heaters, furnaces, electrical lights and electrical equipment not designated for use in hazardous locations.

(a) Installation of dispensing devices:
(1) Not less than 25 feet from any building (not including canopies), basements, cellars, pit or line of adjoining property which may be built upon.
(2) Not less than 50 feet from outdoor places of public assembly including school yards, athletic fields and playgrounds.
(3) Not less than 10 feet from public ways, including public street, public easements, highways, thoroughfare and sidewalks.
(b) Dispensing devices shall be either installed on a concrete foundation or be part of a complete storage and dispensing unit mounted on a common base. In either case, they shall be adequately protected against physical damage.
(c) Controls for the pumping system used to transfer liquefied petroleum gas through the dispensing device into the motor fuel tank or containers shall be provided at the device in order to minimize the possibility of leakage or accidental discharge. Means shall be provided at some point outside the dispensing device, such as a remote switch (NFPA 58, 1979, 3190c) to shut off the power in the event of fire or accident.
(d) A manual shut off valve and an excess flow check of suitable capacity shall be located in the liquid line between the pump and the dispensing device.
(e) The dispensing device hose shall be designed for a minimum bursting pressure of 1750 psig (350 psi working pressure) and shall be marked with “LP-Gas” or “LPG” and with a working pressure at intervals not greater than 10 feet.
(f) An excess flow check valve or an automatic shut off valve shall be installed at the terminus of the liquid piping at a point of attachment of the dispensing device.

(a) In the interest of safety, all persons employed in the handling of liquefied petroleum gas shall be trained in the proper handling and operating procedures.
(b) At least one qualified person shall remain at or near the transfer operation from the time connections are made until the transfer is completed, shut off valves are closed and lines disconnected.
(c) Transfer personnel shall exercise precaution to assure that all liquefied petroleum gases transferred are those for which the transfer system and the containers to be filled are designed.

The authorities having jurisdiction shall be notified immediately when the use of any liquefied petroleum gas equipment is to be abandoned. Such equipment shall be abandoned in a manner approved by the authorities having jurisdiction.

If the State of Kansas has a mandated registration system for such vehicle using liquefied petroleum gas as a motor fuel and the vehicle has complied with the state requirements, no further conditions will be imposed by this article.

The governing body shall have the authority to seek and file criminal complaints with the city or county attorney or some other form of redress for a violation of this article.
