ARTICLE 1. GENERAL PROVISIONS
There is hereby established a municipal court for the City of Beloit, Kansas. The municipal court shall have jurisdiction to hear and determine cases involving violations of the ordinances of the city.

The Kansas code of procedure for municipal courts, as set forth in K.S.A. 12-4101 et seq. and all acts amendatory or supplemental thereto shall govern the practice and procedure in all cases in the municipal court.

The municipal court shall be presided over by a municipal judge. The mayor, with the consent of the council, shall appoint the judge of the municipal court.

The municipal judge shall have such powers and duties as set forth in the Kansas code of procedure for municipal courts (K.S.A. 12-4101 et seq.) and all acts amendatory or supplemental thereto.

(a) In accordance with Charter Ordinance No. 5, the court costs are increased to $125.00 for each person found guilty of a violation of an ordinance of the City of Beloit preserving the existing exemption for parking violations, provided that no more than one court cost shall be assessed per incident, no matter the number of charged violations arising from said incident.
(b) All court costs collected by the municipal court or the clerk of the court shall be paid pursuant to Kansas Statutes and the rules, regulations and orders of the Municipal Court.
(c) All monies remaining in the hands of the municipal court or the clerk of the court after the payments as set out in subsection (b) shall be paid to the general fund of the city.

(a) No attorney, without his or her consent, shall be required to represent parties in Municipal Court cases with indigent defendants.
(b) The Municipal Court shall establish a list of attorneys who volunteer to be appointed by the court to represent parties in indigent cases. Appointments shall be made on a rotating basis, except when a conflict of interest exists or other good cause is shown to the municipal judge.
(c) Beginning August 1, 2022, for court appointed attorney services, the appointed attorneys shall be compensated at the rate of $120.00 per hour. In addition, attorneys shall be reimbursed for all necessary out of pocket expenses including photocopies, postage, and mileage, which shall be paid at a rate not to exceed that paid by the State of Kansas.
(d) Court appointed attorneys shall submit itemized invoices on a regular basis to the municipal court clerk, and no later than 30 days after the termination of a case. The invoices will be examined and approved, or approved as modified, by the municipal judge.
(e) The allowed fees and out of pocket expenses may be reimbursed to the court through collection at the time court costs are paid, or may be reimbursed to the court as a condition of probation, unless the municipal judge finds that such payment or reimbursement would be an undue hardship to the person for whom the services were rendered.
